Mesothelioma Lawsuit Legislation

Mesothelioma Lawsuit Legislation News 06/05/2012: The Neil Abramsons Asbestos Bankruptcy Trust Transparency Bill failed to pass the Louisiana Senate however, this does not mean this will be the last that we will see of similar bills as it has been reported that other States are considering similar bills that would greatly effect Mesothelioma victims filing Mesothelioma Lawsuit cases to recover damages caused by Mesothelioma Cancer, caused by Asbestos Exposure in the workplace.

Although legislators pushing Mesothelioma Lawsuit legislation may be well intended, if one tends to believe politicians are ever well intended however, regardless of their intentions, legislation like the Bill that failed to pass in Louisiana are unnecessary and would only serve to create an unnecessary burden on victims of Mesothelioma Cancer victims and the lawyers handling their Mesothelioma Lawsuit Cases.

The concern over any lack of transparency in how Mesothelioma Trusts are handled is unfounded. The discovery process that exists as part of all civil lawsuits brought before a court in the United States, with the exception of small claims court and other lower courts, is very broad. The discovery process in a Mesothelioma Lawsuit allows both the plaintiff and the defendants to ask questions, take depositions and explore any issue they believe needs exploring. Facts and information that are not even admissible in court may well still be subject to discovery rules.

Speculation as to the motivations behind any legislation dealing with the billions of dollars held in Mesothelioma Bankruptcy Trusts is extensive. Putting aside the issue surrounding Mesothelioma Bankruptcy Trusts, employers who exposed their employees to Asbestos in the past and even the present face paying out millions if not billions of dollars in Mesothelioma Lawsuit claims. These employers would likely be pleased to see any legislation pass that made the jobs of every Mesothelioma Lawyer more difficult even if that legislation did not directly affect them. If one law is past that limits the rights of Mesothelioma Cancer Victims then the employers that exposed their employees to asbestos can hope that future legislation may also follow that would provide them some protections from Mesothelioma Lawsuit cases filed by employees they exposed to Asbestos that ended up contracting Mesothelioma Cancer.
