A jury has awarded an $8.4 million verdict to a mesothelioma patient's widow after finding Hercules, Inc., a subsidiary of Ashland, Inc., responsible for the patient's mesothelioma, a rare cancer caused by exposure to asbestos (Case No. DC10-08454-D, Civil District Court of Dallas County, 68th, TX.). The mesothelioma verdict is believed to be the first asbestos verdict reached against Hercules, Inc. for asbestos exposure at a Dow Chemical plant and may set a precedent for similar results. The mesothelioma lawsuit was filed on behalf of John Gensler, deceased, and his wife Martha Gensler. "Hercules has a documented history of environmental contamination and corporate malfeasance," said mesothelioma lawyer John Langdoc. "While other asbestos pipes contained around three to five percent asbestos, Hercules' asbestos-containing pipes were 50 percent asbestos, an amount found to be highly dangerous to people and the environment."
During the three-week mesothelioma trial, Langdoc and Kalantzakis proved that Hercules, Inc. knew it was exposing Mr. Gensler and other workers to toxic asbestos pipe products throughout the late 1960s and early 1970s, but did nothing to warn workers. Even after the government began to require warning labels for products containing asbestos in 1971, Hercules chose to not place warning labels on its products
